Regulation on granting of operating permits for technical devices used at hazardous production facilities *1
I. General Provisions
1.1. The present Regulation has been developed in compliance with the Federal Law “Industrial safety of hazardous production facilities” dated July 21, 1997, No. 116-FZ (Collection of Legislative Documents of RF, 1997, No. 30 Article 3588); with the Rules for the Use of technical devices at hazardous production facilities approved by the government of RF on December 25, 1998, No. 1540 (Collection of Legislative Documents of RF, 1999, No.1, Article 191) and with the Regulation on the Federal mining and industrial oversight of Russia, approved by the Resolution of the RF government dated December 3, 2001, No. 841 (Collection of Acts of the President and Government of RF)
1.2. The present Regulation establishes the order and terms of granting of operating permits for certain types of technical devices, including those of foreign origin, used at hazardous production facilities. This Regulation is obligatory to be followed by all legal entities, regardless their proprietary form, carrying out activities associated with the design, assembly, adjustment, maintenance and repair of the said devices or operating hazardous production facilities.
1.3. Industrial safety of hazardous production facilities – is a necessary condition for emergency protection of people’s vitally important interests at hazardous production facilities and their possible consequences (Article 1 of the Federal Law “Industrial safety of hazardous production facilities” dated July 21, 1997 No. 116-FZ)
Hazardous production facilities, in compliance with the Federal Law “Industrial safety of hazardous production facilities” dated July 21, 1997 No. 116-FZ, are those facilities or their workshops, sites, areas and other industrial facilities specified in Annex 1 to the Federal Law “Industrial safety of hazardous production facilities” dated July 21, 1997 No. 116-FZ
1.4. Operating permit can be issued for a solitary technical device, for a batch or for a type of technical devices. It is allowed to issue one permit for a dimension-type range of technical devices of the same purpose provided following the united design approach, used materials and technologies.
1.5. Operating permit for a type of technical devices is to be issued to a manufacturer or to its official representative upon submission of corresponding documents and the application for the granting of an operating permit for technical devices used at hazardous production facilities.
1.6. It is allowed to issue permits for packaged technical devices in which all the components are performing interconnected technological functions, on condition that all those components comply with the industrial safety requirements.
1.7. Term of registration of an operating permit can not exceed 2 months from the date of submission of the required set of documents.
II . Operating Permits Issuing
2.1. For obtaining an operating permit for technical devices the applicant (developer, manufacturer) should submit the following documents to Gosgortechnadzor (Rostechnadzor) of Russia:
- Acceptance Test report, information on defects that have been found and eliminated during the test;
- Technical documentation, including testing technique for this device and its main parts, operation life, conditions and requirements for a safe operation, order of maintenance, and repair, and diagnostics;
- Technical conditions (this is a document according to which this device has been produced);
- Certificate of conformity with the industrial safety requirements;
- The applicant also can provide the conclusion of industrial safety assessment of the technical device.
2.2. Fullness and correctness of the conducted tests and assessments, as well as of the submitted technical documents must be estimated (while considering the documents).
2.3. According to item 6 of the Rules for the use of technical devices at hazardous production facilities approved by the Resolution of the RF government on December 25, 1998, No. 1540, the list of technical devices, used at hazardous production facilities and subject to certification, must be approved in an order established by the government of the Russian Federation.
2.4. Bench tests of technical devices of a large size can be conducted in the place of their production on the certified test benches of the manufacturer.
2.5. Upon the results of examination of the submitted documents Gosgortechnadzor (Rostechnadzor) of Russia makes a decision on granting or refusal to issue a permit for the use of a technical device.
2.6. Operating permits for technical devices manufactured abroad are to be issued by Gosgortechnadzor (Rostechnadzor) of Russia in a common order.
2.7. To obtain an operating permit for technical devices, the applicant should submit all the necessary technical documentation in the Russian language to Gosgortechnadzor (Rostechnadzor) of Russia.
2.8. In case of noncompliance of technical devices of foreign origin with some industrial safety requirements which are valid in the Russian Federation, the applicant should submit recommendations for additional actions to provide safety of these devices.
2.9. In case of positive results of the examination of submitted documents, the applicant is given an operating permit for technical devices manufactured abroad.
2.10. Operating permits for technical devices produced abroad and used outside the Russian Federation, should be issued only after a corresponding assessment has been made.
III. Acceptance tests of pilot samples (of technical devices)
3.1. Pilot samples of technical devices are allowed to acceptance tests at hazardous production facilities by Gosgotechnadzor and upon consent of the company-operator – the customer that ordered the equipment – to conduct acceptance tests.
3.2. To start the tests of pilot samples of technical devices, the applicant (developer) must submit the following technical documentation:
- an order of organization on commission appointment with the facility mentioning at which these acceptance tests are to be conducted
- coordinated technical task for the development of a technical device;
- a program and acceptance testing technique coordinated with Gosgortechnadzor (Rostechnadzor) for pilot samples (of the batch) of technical device;
- technical conditions for production a pilot sample of a technical device;
- operating instruction for technical devices, their repair, assembly and technical maintenance;
- Passport (technical certificate) of the device
- Notification (or a report) on results of preliminary (factory) tests and readiness to provide technical devices for acceptance tests.
3.3. For explosion-proof equipment a special conclusion from an accredited testing body (organization) should be submitted.
3.4. When testing a technical device, an official from Gosgortechnadzor (Rostechnadzor) of Russia should be involved into the special commission. This official’s participation in the trails should be coordinated before these tests have begun.
3.5. Should no safety requirements (for staff and third parties) are followed while conducting tests of technical devices, the official from Gosgortechnadzor (Rostechnadzor) of Russia has the right to suspend the acceptance testing until the required conditions for further trails are fulfilled.
IV. Suspension of permits validation (for technical devices)
4.1. Gosgortechnadzor (Rostechnadzor) of Russia has the right to suspend the activity of an operating permit if the commission, that investigated the technical causes of an accident or an emergency situation at a hazardous production facility, is documented that the cause of what happened was the result of constructional defects of a technical device, uncoordinated alteration of constructions affecting the staff’s safety as well as breach of terms of the permit validity.
4.2. Gosgortechnadzor (Rostechnadzor) makes a decision to revive the permit or to terminate it on the ground of the results of the documents examination with the participation of all the interested parties not later than 6 months from the moment of the permit activity has been suspended or within one month from the day of the manufacturer’s application with the proof of defect correction.
4.3. In case of technical conditions change (of a construction or technological processes) the obtaining of an operating permit for technical devices should be executed in compliance with Chapter II of the present Regulation.
